Efter överklagande av kommunen har Patent- och marknadsöverdomstolen undanröjt Patent- och marknadsdomstolens dom och återförvisat målet till Patent- och marknadsdomstolen för fortsatt behandling på grund av att domen var så otydlig att det inte framgick hur Patent- och marknadsdomstolen hade dömt i saken.
