Patent- och marknadsöverdomstolen har härutöver upphävt underinstansens beslut om ersättning av allmänna medel

Patent- och marknadsöverdomstolen har, i likhet med Patent- och marknadsdomstolen, upprätthållit Konsumentombudsmannens beslut i vilket ett bolag har förbjudits att i sociala mediekanaler marknadsföra alkoholdryck gentemot konsument genom att visa bilder på drycken tillsammans med maträtter eller matingredienser. Till skillnad från underinstansen har Patent- och marknadsöverdomstolen även upprätthållit Konsumentombudsmannens beslut att förbjuda bolaget att i sådan marknadsföring visa bilder på en förpackning med öl monterad på en tunna. Patent- och marknadsöverdomstolen har härutöver upphävt underinstansens beslut om ersättning av allmänna medel. Beslutet får överklagas. En ledamot var skiljaktig.
