Konkurrensverket har med stöd av 5 kap. 1 § konkurrenslagen beslutat att ålägga två företag inom livsmedelsbranschen att inkomma med upplysningar och handlingar beträffande bl.a. prissättningsstrategier. Patent- och marknadsöverdomstolen har funnit att motiveringen i åläggandet inte har varit tillräckligt utvecklad för att domstolen ska kunna bedöma behovet av samtliga upplysningar och handlingar som begärts. Åläggandet har därför delvis upphävts. I ärendet har även uppkommit frågor om rätt till ersättning av allmänna medel för rättegångskostnader vid överklagande av sådant åläggande enligt konkurrenslagen. Patent- och marknadsöverdomstolen har tillåtit att beslutet överklagas till Högsta domstolen.
