I ett mål om undersökning enligt 5 kap. 3 § konkurrenslagen (2008:579) (s.k. gryningsräd) begärde klaganden, med hänvisning till sin rätt till partsinsyn, att vissa handlingar som Konkurrensverket hade gett in i målet skulle lämnas ut. Konkurrensverket motsatte sig begäran på den grunden att handlingarna omfattades av utredningssekretess enligt 17 kap. 3 § offentlighets- och sekretesslagen (2009:400). Eftersom målet handlades enligt bestämmelserna i lagen (1996:242) om domstolsärenden var den sk. kollisionsregeln i 10 kap. 3 § första stycket offentlighets- och sekretesslagen tillämplig. Patent- och marknadsöverdomstolen bedömde att handlingarna inte skulle lämnas ut till klaganden eftersom det var ett allmänt intresse av samhällelig vikt att skydda uppgifter i den pågående utredningen. Däremot hade klaganden rätt att få upplysning om innehållet i handlingarna i den utsträckning som behövdes för att kunna tillvarata sin rätt i ärendet.
