Tillstånd till bortledande av grundvatten ----- Den omständigheten att tillåtligheten av verksamheten var prövad genom vägplan utgjorde enligt Mark- och miljööverdomstolen inte hinder mot att genom villkor begränsa inläckaget av grundvatten. Mark- och miljööverdomstolen fann dock att det i detta fall inte var lämpligt med slutliga villkor med fasta gränser för tillåtna mängder inläckande vatten. I stället fann Mark- och miljööverdomstolen att ett förordnande under prövotid med omfattande kontrollåtgärder och avstämning med tillsynsmyndigheten var lämpligt. Prövotidsföreskrifterna innebar att behovet av skyddsåtgärder vid avvikelser från prognosticerade läckagevärden och sänkta grundvattennivåer ska bedömas med hänsyn till risken för omgivningspåverkan. Bedömningen ska ske i samråd med tillsynsmyndigheten och vid oenighet i frågan har tillsynsmyndigheten rätt att fatta beslut.
