En uppsagd arbetstagare har väckt talan om uppsägningens ogiltighet efter det att uppsägningstiden gått ut och anställningen upphört. Arbetsgivaren, som menar att ogiltighetstalan är preskriberad, har begärt ett interimistiskt beslut enligt 34 § tredje stycket anställningsskyddslagen om att anställningen ska upphöra i avvaktan på att tvisten blir avgjord. Arbetsdomstolen konstaterar att arbetstagaren inte kan göra gällande någon rätt enligt 34 § andra stycket anställningsskyddslagen om att stå kvar i anställningen under tvisten, eftersom anställningen hade hunnit upphöra när tvisten uppkom. Arbetsgivaren kan därför inte få något interimistiskt beslut om att anställningen ska upphöra.
