En arbetstagare har under flera års tid begärt och beviljats ledigt från sitt arbete för studier. När arbetsgivaren har ifrågasatt studierna har arbetstagaren vidhållit att denne ägnat sig åt studier och haft rätt till ledighet på grund av dessa. Arbetsdomstolen har kommit fram till att arbetstagaren inte har haft rätt till ledighet enligt studieledighetslagen och att arbetstagaren medvetet lämnat felaktiga uppgifter till bolaget om sina studier. Arbetstagaren har därmed enligt Arbetsdomstolens mening grovt åsidosatt sina åligganden mot bolaget och skäl för avskedande har förelegat.
