Två deltidsanställda säljare i en kosmetikbutik anmälde till sin arbetsgivare att de ville ha en anställning med en högre sysselsättningsgrad i samband med att en av de andra säljarna sade upp sin anställning i butiken. Den säljare som slutade hade haft en anställning med samma sysselsättningsgrad som de två som önskade arbeta mera. Arbetsgivaren erbjöd inte dessa två någon högre sysselsättningsgrad utan anställde i stället en ny person för den säljare som hade slutat och med samma sysselsättningsgrad som hon hade haft.
