Två arbetstagare avböjde båda alternativen och blev uppsagda
En kommun har ställt ett antal fritidspedagoger inför alternativen att antingen ta ut tjänstledighet om 25 procent under två år eller omreglera anställningen till en sysselsättningsgrad om 75 procent av heltid. Arbetstagarna har i samband härmed upplysts om att de riskerade sin anställning för det fall de avböjde båda alternativen utan godtagbart skäl. Två arbetstagare avböjde båda alternativen och blev uppsagda. Tio arbetstagare stannade för alternativet tjänstledighet och en arbetstagare stannade för alternativet omreglering till en sysselsättningsgrad om 75 procent av heltid. Dessa elva arbetstagare klargjorde att de motsatte sig förändringarna. Kommunen vidtog förändringar i enlighet med de alternativ som dessa arbetstagare valt. Tvist huvudsakligen huruvida kommunens åtgärder har stått i strid mot anställningsskyddslagen. Även fråga om brott mot föräldraledighetslagen och medbestämmandelagen.
