Om en arbetsgivare vill att en arbetstagare skall lämna sin anställning i samband med att arbetstagaren får rätt till hel sjukersättning som inte är tidsbegränsad, skall arbetsgivaren enligt 33 § andra stycket anställningskyddslagen skriftligen ge besked till arbetstagaren om detta så snart arbetsgivaren har fått kännedom om beslutet om sjukersättning. Arbetsdomstolen har funnit att en arbetsgivare är berättigad att avsluta anställningen enligt denna bestämmelse först då det föreligger ett lagakraftvunnet beslut om hel sjukersättning utan tidsbegränsning.
