En arbetstagare har efter ett möte med arbetsgivarens verkställande direktör inte utfört arbete i arbetsgivarens verksamhet. Arbetsgivaren har haft grundad anledning att inse att arbetstagaren med fog uppfattat sig som skild från anställningen men har inte agerat för att undanröja missförståndet. Händelseförloppet har enligt Arbetsdomstolen därför jämställts med ett avskedande. Arbetsdomstolen har även funnit att arbetsgivaren ska betala skadestånd för formaliafel - s.k. konsekvensskadestånd - enligt 19 och 30 §§ anställningsskyddslagen.
