Patent- och marknadsöverdomstolen har ändrat Patent- och marknadsdomstolens beslut att efter omprövning upphäva ett tidigare meddelat interimistiskt vitesförbud pga. intrång i ett läkemedelspatent. Detta har fått till följd att det interimistiska vitesförbudet fortsatt gäller. Med beaktande av den s.k. giltighetspresumtionen har Patent- och marknadsöverdomstolen bedömt att intrångsvarandena inte har förmått påvisa att det på grund av nya omständigheter eller ny bevisning som inte beaktats under prövningen då patentet meddelades, eller på grund av brister eller felaktigheter i det beslut som fattats vid det administrativa förfarandet, framstår som sannolikt att patentet kommer att ogiltigförklaras i den slutliga prövningen. Patent- och marknadsöverdomstolens beslut får inte överklagas.
