Patent- och marknadsöverdomstolen har inte tillåtit överklagande av beslutet

Patent-och marknadsöverdomstolen har tagit ställning till om lilla riksvapnet utgör hinder mot registrering av fem varumärken i figur bestående av tre öppna gula kronor. Vid en jämförelse mellan märkeselementen i de sökta varumärkena och den beskrivning (blasonering) av lilla riksvapnet som framgår av lagen om Sveriges riksvapen har Patent- och marknadsöverdomstolen funnit att de sökta varumärkena innehåller sådana element som lätt kan förväxlas med lilla riksvapnet. Patent- och marknadsöverdomstolen har därför, i likhet med Patent- och marknadsdomstolen, bedömt att det föreligger hinder mot att registrera varumärkena. Patent- och marknadsöverdomstolen har inte tillåtit överklagande av beslutet.
