Förbud mot viss vedeldning ----- Fråga om av länsstyrelsen förelagda försiktighetsmått och begränsningar beträffande vedeldning på fastigheter belägna på viss gata. Med stöd av 26 kap. 9 § miljöbalken hade länsstyrelsen förelagt om villkor för vedeldning på fastigheter belägna på viss gata. Någon individuell bedömning av eventuella bidrag till påtalade olägenheter från respektive fastighet hade inte skett och det fanns inte någon tydlig adressat i föreläggandet. Mark- och miljööverdomstolen har funnit att föreläggandet var utformat som en generell föreskrift. En sådan generell föreskrift om tillfälligt förbud mot småskalig eldning med vissa fasta bränslen inom särskilt angivet område får kommunen meddela om det behövs för att hindra att olägenheter för människors hälsa uppkommer i kommunen. Länsstyrelsen har således inte haft behörighet att meddela sådana föreskrifter. Föreläggandet har undanröjts och målet återförvisats till nämnden för vidare utredning.
