Föreläggande om vattenhushållning; tillsynsbeslut ----- En tillsynsmyndighet har i ett föreläggande föreskrivit ägaren av en dammanläggning att hålla vissa dämningsgränser. Dammägaren överklagade tillsynsmyndighetens beslut och menade att det saknades utredning i målet som visade att just de föreskrivna nivåerna var lämpliga eller att de av honom föreslagna nivåerna var olämpliga. Den vattenverksamhet som bedrivs vid den aktuella dammen har inte tillståndsprövats. Mark- och miljööverdomstolen konstaterade att föreläggandet innebar ett åläggande att utan föregående tillståndsprövning följa vissa bestämmelser om vattenhushållningen. Enligt Mark- och miljööverdomstolens mening bör en sådan reglering inte ske utan samband med en tillståndsprövning, där motstående intressen kan belysas och där det kan göras en allsidig bedömning av vilka regleringsnivåer som är lämpligast. Överklagandet bifölls på så sätt att föreläggandet upphävdes.
