Undantaget i 7 kap. 17 § miljöbalken var därmed inte tillämpligt

Föreläggande vid vite att avbryta byggnadsarbeten på ett förråd avsett för fiske ----- Miljööverdomstolen (MÖD) ansåg att länsstyrelsen haft fog för sitt föreläggande. Det hade nämligen inte visats att det fiske som hittills bedrivits varit av sådan omfattning eller varaktighet att det kunde betecknas som en bisyssla. Undantaget i 7 kap. 17 § miljöbalken var därmed inte tillämpligt. Byggnaden ansågs inte heller krävas för fisket vid tillämpning av förordnandet till skydd för landskapsbilden. Sålunda krävdes både dispens från strandskyddsbestämmelserna och tillstånd enligt nämnda förordnande. Vitesbeloppet sattes dock ned.
