Family and Medical Leave Act

29 U.S.C. §§ 2601 to 2654, 29 CFR Part 825 · Read 2026-08-15

In force since 1993. It gives an eligible employee up to twelve workweeks of unpaid, job protected leave in a twelve month period, and up to twenty six weeks of military caregiver leave. The leave is unpaid at federal level, several states run paid programmes on top.

  • Eligibility

    29 CFR 825.110

    Twelve months of service, 1250 hours worked and a worksite with fifty employees within seventy five miles.

  • Leave entitlement

    29 CFR 825.200

    Twelve workweeks, and the measurement of the twelve month period.

  • Military family leave

    29 CFR 825.126

    Qualifying exigency leave and twenty six weeks of military caregiver leave.

  • Job restoration

    29 CFR 825.214

    Return to the same or an equivalent position with equivalent pay and benefits.

  • Notice and certification

    29 CFR 825.300

    Employer notices, employee notice and medical certification.
