En kommun väckte talan mot ett bolag om förpliktelse att betala en avgift för att offentlig plats upplåtits till bolaget. Tingsrätten avvisade käromålet eftersom domstolen fann att talan föll under förvaltningsprocessens exklusiva område. Enligt tingsrätten var kommunens beslut om fakturering ett förvaltningsbeslut som utgjorde en exekutionstitel enligt 3 kap. 1 § utsökningsbalken, eftersom beslutet innefattade betalningsskyldighet och kunde överklagas i annan ordning än den som gäller för laglighetsprövning enligt 13 kap. kommunallagen. Allmän domstol ansågs därför inte behörig att pröva talan. Hovrätten har undanröjt tingsrättens avvisningsbeslut på den grunden att det inte har uppkommit någon exekutionstitel och att tingsrätten därför haft att pröva målet om fordran i den ordning som gäller för tvistemål i allmänhet.
