Patent- och marknadsöverdomstolen har ogillat en talan om ogiltigförklaring av ett patent samt ett tilläggsskydd. I målet gjordes det gällande att sökanden inte hade rätt att åberopa prioritet från en tidigare ansökan eftersom prioritetsrätten inte hade överlåtits till sökanden innan patentansökan gavs in och att uppfinningen därför saknade nyhet. Patent- och marknadsöverdomstolen ansåg att prövningen av prioritetsfrågor bör ske på motsvarande sätt som i Europeiska patentverket. Sökanden ska presumeras ha rätt att åberopa prioritet och för att motbevisa presumtionen krävs att det föreligger konkreta omständigheter som innebär att det finns allvarliga tvivel om sökandens rätt till prioritet. Några sådana omständigheter ansågs inte föreligga. I målet prövades även frågor om beskrivningens tydlighet, uppfinningshöjd och stöd i grundhandlingarn. Domen får inte överklagas.
