Patent- och marknadsöverdomstolen har - till skillnad från Patent- och marknadsdomstolen - bedömt att det inte har funnits förutsättningar att meddela sådant beslut och har därför upphävt det överklagade beslutet. Patent- och marknadsöverdomstolen har inte tillåtit överklagande av beslutet.
