I mål om påstått intrång i ensamrätt till ett fotografi bestående i otillåten exemplar­framställning och otillåten överföring till allmänheten uppkom frågan om en domstol kan vara allmänheten i detta avseende. Det gjordes gällande att en person begått intrång i ensamrätten till fotografisk bild genom att skriva ut ett fotografi från fotografens blogg, framställa en digital kopia av fotografiet och därefter skicka in den digitala kopian av fotografiet med e-post till en domstol som bevisning i ett mål om förtal. Efter erhållet förhandsbesked från EU-domstolen konstaterade Patent- och marknadsöverdomstolen att ingivandet av fotografiet till domstolen inte utgjorde överföring till allmänheten. Vidare fann Patent- och marknads­överdomstolen att den exemplarframställning som skett av fotografiet inte utgjorde någon otillåten exemplar­framställning eftersom den omfattades av inskränkningen i ensamrätten avsende rättsvårdens intresse. Patent- och marknadsöverdomstolen har inte tillåtit överklagande av domen.
