Patent- och marknadsöverdomstolens dom får inte överklagas

Patent- och marknadsöverdomstolen har bedömt att patentintrång inte förelegat eftersom de påtalade produkterna satts på marknaden med patenthavarens samtycke genom en licens till det bolag som tillverkat och sålt produkterna till den påstådde intrångsgöraren. Patent- och marknadsöverdomstolen har härvid ansett att avtalstiden för patentlicenser, om annat inte överenskommits mellan parterna, gäller för patentets livslängd.
