Patent- och marknadsöverdomstolen har ansett att Konkurrensverket inte haft giltig ursäkt att först i Patent- och marknadsöverdomstolen åberopa ny bevisning. Efter en lagändring den 1 september 2016 gäller rättegångsbalkens regler om preklusion även i mål enligt konkurrenslagen. Patent- och marknadsöverdomstolen har ansett att eftersom frågan inte reglerats särskilt i övergångsbestämmelserna, ska reglerna om preklusion tillämpas från dagen för ikraftträdande. De nya reglerna har varit kända för parterna sedan lagen (2016:188) om patent- och marknadsdomstolar utfärdades av riksdagen den 10 mars 2016. Parterna anses i det aktuella målet haft möjlighet att anpassa utformandet av sin talan i tingsrätten därefter. Konkurrensverket tilläts därför inte åberopa ny bevisning.
