Föreläggande om åtgärder samt avgifter för tillsyn ----- En tillsynsmyndighet har riktat ett åtgärdsföreläggande mot fastighetsägaren i stället för mot den tidigare verksamhetsutövaren, som var försatt i konkurs, med hänvisning till fastighetsägarens subsidiära ansvar enligt 10 kap. 3 § första stycket miljöbalken. Mark- och miljööverdomstolen har dock ansett att den utredning som tillsynsmyndigheten gjort inte var tillräcklig för att dra slutsatsen att verksamhetsutövaren saknade förutsättningar att utföra eller bekosta ett avhjälpande vid tidpunkten för föreläggandet. Åtgärdsföreläggandet har därför upphävts. (mål nr M 8447-22 och M 8453-22)
