Inhibition av villkor i tillstånd till invändig disk av tankar m.m. ----- En domstol har befogenhet att besluta att ett verkställighetsförordnande inte ska avse ett för tillståndet meddelat villkor. Miljööverdomstolen har tidigare uttalat att det dock endast i undantagsfall bör komma i fråga att inskränka ett verkställighetsförordnande på detta sätt. I detta fall hade länsstyrelsen, kommunen samt närboende motsatt sig ett beslut om inhibition. Med hänsyn till detta och till att det endast i undantagsfall bör komma i fråga att besluta att ett verkställighetsförordnade inte ska avse ett visst villkor ansåg Mark- och miljööverdomstolen att det inte funnits tillräckliga skäl att meddela inhibition avseende villkor i det meddelade tillståndet. Mark- och miljööverdomstolen upphävde mark- och miljödomstolens förordnande om att två av villkoren i tillstånd till invändig disk av tankar, containrar och behållare m.m. tills vidare inte skulle gälla.
