Efter att grannar överklagat upphävde länsstyrelsen nämndens beslut och förbjöd viss användning av avloppsanläggningen. Nämnden överklagade till miljödomstolen. I Miljööverdomstolen (MÖD) uppkom fråga om nämndens rätt att överklaga länsstyrelsens beslut. MÖD konstaterade att länsstyrelsens beslut inte hade gått emot de allmänna intressen som nämnden har att företräda och att nämnden därför inte hade rätt att överklaga länsstyrelsens beslut.
