Miljösanktionsavgift för utebliven produktionsuppgift för täkt ----- Miljööverdomstolen (MÖD) fann att begreppet näringsidkare i 30 kap. miljöbalken skulle ges samma innebörd som i övriga delar av svensk rätt. I målet var inte visat att någon näringsverksamhet i form av grustäkt hade bedrivits under det aktuella året. Inte heller den torvtäkt som bedrivits hade varit av den omfattning eller varaktighet att den kunde anses som näringsverksamhet. MÖD upphävde beslutet att påföra miljösanktionsavgift.
