Miljösanktionsavgift ----- Ett handelsbolag hade utan att göra anmälan till tillsynsmyndigheten påbörjat hantering och uppläggning av avfall varför miljösanktionsavgift påfördes. Miljööverdomstolen fastställde avgiften och uttalade att frågan om någon förorening kunnat konstateras i det enskilda fallet saknade betydelse för anmälningsplikten i bilagan till förordningen (1998:899) om miljöfarlig verksamhet Den uppläggning som bolaget hade gjort hade medfört en i vart fall ringa risk för förorening och därför var det riktigt av tillsynsmyndigheten att påföra avgiften utan närmare utredning om detta.
