En byggnadsarbetare som var facklig förtroendeman har avskedats under påståenden om att han ska ha hotat en kollega och ha haft omfattande samarbetsproblem. Arbetsdomstolen har funnit att avskedandet varit i strid med 18 § anställningsskyddslagen. Tvisten gäller även om avskedandet varit föreningsrättskränkande samt om arbetsgivaren genom andra åtgärder hindrat arbetstagaren från att fullgöra sitt fackliga uppdrag och utsatt honom för föreningsrättskränkning. Slutligen även fråga arbetsgivaren brutit mot 4 och 5 §§ förtroendemannalagen samt om arbetsgivaren brutit mot byggavtalet genom att begära förstadagsintyg.
