Målet gällde ogiltigförklaring av avskedande mm. En besiktningstekniker, anställd i Aktiebolaget Svensk Bilprovning, har blivit avskedad. Enligt arbetsgivaren har besiktningsteknikern vid ett tillfälle tillgripit pengar ur arbetsgivarens kassa alternativt på visst sätt handlat i strid med de interna redovisningsrutinerna. Vidare har arbetsgivaren gjort gällande att det funnits misstankar om att arbetstagaren vid ett icke ringa antal tillfällen gjort sig skyldig till oegentligheter. Enligt domstolen kan enbart misstankar om oegentligheter eller brott inte läggas till grund för ett avskedande eller en uppsägning. Domstolen har dock funnit utrett att besiktningsteknikern vid ett tillfälle hanterat redovisningen av kassan på ett icke korrekt sätt och underlåtit att rapportera det inträffade till arbetsgivaren. Domstolen har emellertid funnit att det varken funnits skäl för avskedande eller för uppsägning.
