Sedan en arbetstagare hos Europeiska Kommissionen med placering vid dess kontor i Stockholm avskedats, väckte arbetstagaren talan vid tingsrätten med yrkanden om skadestånd på grund av avskedandet. Arbetstagaren yrkade under målets handläggning att Europeiska Kommissionen skulle föreläggas att utge vissa skriftliga handlingar, vilka enligt arbetstagarens mening kunde antas ha betydelse som bevis. Sedan yrkandet om editionsföreläggande bestritts av Europeiska Kommissionen, beslutade tingsrätten att inhämta ett förhandsavgörande från EG-domstolen rörande denna fråga och att vilandeförklara målet i avvaktan på förhandsavgörandet. Sedan beslutet överklagats särskilt med stöd av 49 kap. 7 § rättegångsbalken, har Arbetsdomstolen funnit att tingsrättens beslut medför att målet försenas i onödan. Arbetsdomstolen har därför undanröjt beslutet och visat målet åter till tingsrätten för fortsatt handläggning.
