En tingsrätt har i ett mål om åldersdiskriminering beslutat att inhämta förhandsavgörande från EU-domstolen och förklarat att målet ska vara vilande under den tid handläggningen pågår i EU-domstolen. Svarandeparten har i enlighet med 49 kap. 7 § rättegångsbalken överklagat beslutet särskilt på den grunden att det medför att målet försenas i onödan. Arbetsdomstolen, som uttalar bl.a. att bedömningen av om det kan anses obehövligt att inhämta ett förhandsavgörande bör göras restriktivt, har avslagit överklagandet.
