Tvist om tillämpningen av en bestämmelse i AB 98, vilken innebär att vissa hälsoundersökningar skall genomföras i nära samförstånd med arbetstagaren. - Efter sammanträde mellan företrädare för en kommun och en hos kommunen anställd idrottslärare undertecknas en överenskommelse om slumpvisa alkoholtester på arbetstid under en viss tid. Sedan ett alkoholtest gett positivt resultat hålls ett nytt sammanträde, som avslutas med att det undertecknas en ny överenskommelse av innebörd dels att alkoholtest skall utföras varje morgon under en viss tid, dels bl.a. att idrottsläraren skall vara hemma från arbetet under två dagar med bibehållen lön. I målet uppkommer följande frågor: a) Har läraren undertecknat överenskommelserna under sådana förhållanden att alkoholtesterna inte har genomförts i nära samförstånd med honom? b) Har läraren avstängts i strid med bestämmelserna i AB 98? c) Har kommunen åsidosatt sin förhandlingsskyldighet enligt 11 § medbestämmandelagen?
