Delgivning med den tilltalade av kallelse dagen före en huvudförhandling har ansetts innebära att den tilltalade inte har fått skäligt rådrum för förberedelse inför och inställelse till förhandlingen. Det har därför förekommit ett rättegångsfel vid tingsrätten då målet avgjorts i den tilltalades utevaro. Hovrätten har undanröjt tingsrättens dom och återförvisat målet till tingsrätten för fortsatt behandling.
