Rättegångskostnader i mål som handläggs enligt ärendelagen ----- Ett yrkande om ersättning för rättegångskostnader i mål som överklagas till mark- och miljödomstol ska prövas, inte avvisas. Vid framgång kan klaganden i undantagsfall få ersättning av det allmänna för befogade rättegångskostnader. I regel kommer det inte i konflikt med rätten till en rättvis rättegång att den enskilde får stå för sina egna rättegångskostnader i sådana mål. (Se NJA 2015 s. 374.)
