Vid husrannsakan hos två personer hittades kontanter som togs i beslag. En tredje person påstod att kontanterna var hans. Alla tre åtalades för penningtvättsbrott. Mot de två första personerna men inte mot den tredje personen framställde åklagaren ett yrkande om att kontanterna skulle tas i förvar med stöd av lagen (1974:1065) om visst stöldgods m.m. I brottmålet i tingsrätten framställde den tredje personen mot de två första personerna ett yrkande om bättre rätt till kontanterna. Det två första personerna medgav yrkandet och tingsrätten biföll det därför. Tingsrätten biföll också åklagarens yrkande mot dem om att kontanterna skulle tas i förvar. Den tredje personen överklagade beslutet om att kontanterna togs i förvar. Hovrätten avvisade överklagandet därför att han inte hade rätt att överklaga beslutet.
