Sedan gäldenären avlidit gjordes utmätning hos gäldenärens dödsbo utan att ny underrättelse sänts till dödsboet. Eftersom underrättelseskyldigheten inte hade fullgjorts skedde utmätningen inte i föreskriven ordning. Kronofogdemyndighetens utmätningsbeslut skulle därför inte fastställas.
