Tilltalad dömdes av tingsrätten för bl.a. misshandel, som bedömdes som ringa, till dagsböter. Åklagaren ensam överklagade och yrkade att den tilltalade skulle dömas för misshandel som ej var ringa till fängelse. Den tilltalade, som gjorde gällande att hovrätten hade att pröva skuldfrågan i hela dess vidd, hemställde att hovrätten skulle ogilla åtalet för misshandel.
