8761-24, 8762-24, 8765-24, 8767-24, 8769-24, 8770-24 Patent- och marknadsöverdomstolen har i likhet med Patent- och marknadsdomstolen kommit fram till att villkoret att det måste finnas ett giltigt godkännande att saluföra en produkt som läkemedel, för att tilläggsskydd ska kunna meddelas, inte är uppfyllt. I detta fall avsåg ansökan om tilläggsskydd en kombinationsprodukt, dvs. en produkt bestående av mer än en aktiv ingrediens, medan produkten som ingick i läkemedlet enligt försäljningsgodkännandet bestod av endast en aktiv ingrediens. Enligt försäljningsgodkännandet kunde läkemedlet kombineras med andra läkemedel/substanser och därmed utgöra så kallade "lösa kombinationer". Patent-och marknadsöverdomstolen, som bedömt att det saknas behov att ställa frågor till EU-domstolen för att avgöra ärendet, har tillåtit att beslutet får överklagas.
