Avvisande av anslutningsöverklagande ----- Sedan ena parten i ett fastighetsbildningsmål överklagat en dom från mark- och miljödomstolen till Mark- och miljööverdomstolen har motparterna i målet, efter överklagandetidens utgång, överklagat domen i en handling rubricerad "Anslutningsöverklagande". På handlingen har mark- och miljödomstolen gjort en anteckning om att överklagandet gjorts i rätt tid. Mark- och miljööverdomstolen avvisade överklagandet och anförde följande. Någon möjlighet att anslutningsöverklaga finns inte eftersom det är lagen (1996:242) om domstolsärenden som tillämpas i målet. Att mark- och miljödomstolen har gjort en rättidsprövning och funnit att överklagandet gjorts i rätt tid kan inte heller medföra att en möjlighet att anslutningsöverklaga har tillskapats.
