Tilldelning av utsläppsrätter ----- Ett bolag har till följd av en författningsändring den 1 juli 2006 kommit att omfattas av systemet för handel med utsläppsrätter. Bolagets anläggning har varit berättigad till tilldelning av utsläppsrätter för handelsperioden utan betalning under förutsättning att bolaget ansökt om detta senast den 31 oktober 2006. Bolaget kom emellertid först senare att göra en sådan ansökan och gjorde gällande att detta var ursäktligt och att bolaget därför borde tilldelas utsläppsrätter utan betalning. Miljööverdomstolen fann att konstruktionen av systemet var svårgenomtränglig, men att bestämmelserna inte kunde tolkas på något annat sätt än enligt deras lydelse och att bolagets ansökan därför skulle avslås.
