Strandskyddsdispens ----- Länsstyrelsen hade med stöd av 7 kap. 17 § andra stycket miljöbalken beslutat att kravet på strandskyddsdispens inte gällde inom ett område för byggnader som utgör komplement till befintlig bebyggelse på en tomtplats och som förläggs längre ifrån strandlinjen än huvudbyggnaden. Miljööverdomstolen fann att undantaget inte var tillämpligt i målet eftersom någon tomtplatsbestämning inte gjorts för huvudbyggnaden. Miljööverdomstolen fann även att hemfridszonen inte obetydligt skulle komma att utvidgas med hänsyn till den nya byggnadens karaktär och storlek. Det förelåg därför inte särskilda skäl för dispens på den grunden att fastigheten redan skulle anses vara ianspråktagen av fastighetsägaren och allemansrätten därmed utsläckt.
