MÖD fann att det inte var fråga om ett återvinningsförfarande som bolaget hävdat utan ett bortskaffningsförfarande eftersom huvudsyftet inte varit att bevara naturresurser. Bolaget hade vidare hävdat att det var fråga om behandling och inte deponering av avfallet. MÖD kom fram till att avfallet i biocellsreaktorn fick anses deponerat då det inte fanns någon avgörande skillnad i förhållande till traditionell deponering i t.ex. bioceller.
