Inför att en arbetsgivare, ett flygbolag, avsåg att anlita en entreprenör för att utföra viss flygverksamhet förhandlades frågan med pilotföreningen enligt 38 § medbestämmandelagen. Entreprenören skulle tillhandahålla bl.a. flygplan och besättning och anlitade i sin tur en underentreprenör för bemanningen av planen. Därefter anlitades en ny underentreprenör för bemanningen av flygplanen. Fråga om arbetsgivaren varit skyldig att på nytt förhandla med pilotföreningen enligt 38 § medbestämmandelagen inför bytet av underentreprenör. Arbetsdomstolen har kommit fram till att det inte funnits någon sådan skyldighet.
