En arbetsgivare har, efter förhandlingar om driftsinskränkningar, sagt upp ett antal arbetstagare. Företrädare för arbetsgivaren respektive arbetstagarorganisationen har vid en förhandling avseende arbetstagare vid en viss region signerat en lista med namnen på arbetstagarna vid den regionen. I listan markerades alla arbetstagare utom tre stycken som "OK". Arbetstagarna sades sedan upp. Förbundet har väckt talan mot arbetsgivarparterna med yrkande om allmänt och ekonomiskt skadestånd på visst sätt för brott mot bestämmelsen om turordning i 22 § anställningsskyddslagen. - I tvisten har fråga uppkommit om den lista, som sålunda signerades, utgör en mellan parterna överenskommen s.k. avtalsturlista. Arbetsdomstolen har avgjort frågan i mellandom och funnit att listan inte är att anse som en avtalsturlista.
