May I sublet my home?

A rental tenancy requires the landlord's consent or the tribunal's permission, a cooperative apartment the board's consent or the tribunal's permission. Where you own the home no consent is required.

What the source says

  • Chapter 12 section 39 of the Land Code: consent from the landlord or permission from the tribunal.
  • Chapter 7 section 10 of the Cooperative Housing Act: consent from the board or permission from the tribunal.
  • Chapter 7 section 18: unauthorised subletting is a ground for forfeiture.

A subtenant has no security of tenure during the first two years in a dwelling.
