May I swap my rental flat?

Yes, where the landlord consents or the rent tribunal grants permission. Permission requires substantial reasons for the swap, that it is not made for payment, and that the landlord has no justified objection.

What the source says

  • Chapter 12 section 35 of the Land Code: the tribunal may permit a swap where substantial reasons exist.
  • Chapter 12 section 35: permission may not be granted where payment has been made for the swap.

For the owner, landlord or seller

Assess the swap partner's ability to pay the rent, that is a justified ground to object.

For the tenant, buyer or client

Keep the evidence of the substantial reasons, the tribunal tests those, not the wish to swap.

Next step

Read the swap rules together with subletting, both need permission but on different grounds.
