Where the jurisdictions diverge

  • The EU tests the transfer in advance against a legal basis, while the United States tests the contract and the conduct afterwards through enforcement.
  • China requires an administrative route before the data leaves the country, a security assessment, certification or the standard contract, which neither the EU nor the United States knows in that form.
  • The breach deadline is the clearest difference: 72 hours in the EU, immediately in China, and in the United States a state-level reasonableness test with no fixed hour limit.
