En operatör är inte skyldig att ge Polismyndigheten tillgång till sådana uppgifter om abonnemang som sparats på grund av de bestämmelser om skyldighet att lagra uppgifter för brottsbekämpande ändamål som tidigare bedömts strida mot EU-rätten och därför inte kunde tillämpas. Operatören ska emellertid lämna ut uppgifter om abonnemang som sparats hos bolaget enligt de regler som ska tillämpas och som gäller misstanke om brott. I denna del hade Post- och telestyrelsen därför rätt att förelägga operatören att lämna ut uppgifter till brottsbekämpande myndigheter som ska ingripa mot brottet oavsett det misstänkta brottets svårhetsgrad.
