Hyresnämndsmål. I ett mål om återbetalning av hyra enligt 12 kap. 55 f § jordabalken kan hyresnämnden bara pröva en ansökan om den kommit in till hyresnämnden inom tre månader från att hyresgästen lämnade lägenheten. Frågan om en ansökan kommit in i rätt tid, ska betraktas som en fråga om ett rättegångshinder och självmant prövas av hyresnämnden. Om ansökan inte getts in i rätt tid, ska ansökan avvisas. Andrahandshyresgästen har bevisbördan för sina påståenden om hyrestidens längd.
